How Does Eve Answer Discovery Dumped Before a Holiday?
Jay Madheswaran says one law firm built an agent on Eve that sends discovery responses the same day a defense team tries to bury them before a holiday. Defense firms still run on an hourly business model and have not caught up to the pace of the attorneys Eve works with, which leaves a pricing asymmetry.
Defense counsel used to wait and push discovery request dates out until a day before Thanksgiving or a major holiday, then send the requests. They expected the lawyer to leave for vacation, get stuck with the workload, and either rush the work or do a poor job. The move had become a repeated tactic, so the firm created an agent on Eve to respond the same day. The next time the requests came through, the responses went back immediately, and the defense side asked what was going on.
Enough variants of the tactic are showing up that defense teams are realizing what happens when the other side has the resources to answer at once.
